Bookcicle’s ghostwriting, editorial, translation, and conversion
services may incorporate generative artificial intelligence
technologies (“AI Systems”) operated by Bookcicle or
third-party vendors. These systems assist in producing text based on
your prompts, data, and instructions.
By submitting prompts, manuscripts, reference materials, or other
inputs for AI-assisted services, you instruct and authorize Bookcicle
to transmit, process, store, transform, analyze, and display such
materials using Bookcicle systems and third-party service providers
reasonably necessary to provide, secure, maintain, moderate, and
support the services, subject to these Terms and our
Privacy Policy.
NO GUARANTEE OF ORIGINALITY OR ACCURACY. AI-generated output is
provided “AS IS.” It may contain material that resembles existing
works, factual errors, or biased/defamatory statements. Bookcicle does
not warrant that any AI-generated content will be free from
plagiarism, copyright infringement, or other violations of third-party
rights.
No Exclusivity; Similar Output.
AI Systems may generate the same or similar output for Bookcicle,
other users, or third parties. Similarity of output does not, by
itself, mean that any person wrongfully copied from you or that any
output is exclusive, confidential, or protectable.
Your Responsibilities.
You are solely responsible for reviewing, editing, and verifying the
originality, accuracy, and legality of any AI-assisted or AI-generated
content prior to publication, distribution, or commercial use, and for
obtaining any permissions or attributions required by law. You
represent and warrant that you have all necessary rights to the
inputs, prompts, reference materials, or other data you submit to
Bookcicle.
Service Expectations.
Unless expressly stated otherwise in an order form or service
agreement, Bookcicle’s AI-assisted services are intended to help move
you substantially toward a workable manuscript or other deliverable,
but they do not promise a completed, publication-ready, or error-free
final work. Any references on the Site to getting you most of the way
to a final draft or deliverable describe the general intended workflow
only and are not guarantees of outcome, quality, completeness, or
fitness for a particular purpose. Results vary based on your inputs,
source materials, instructions, and review process.
Ownership.
Unless otherwise agreed in writing, Bookcicle assigns to you any
transferable rights, if any, it may have in AI-generated content or
other Deliverables created for you, subject to: (i) your compliance
with these Terms; (ii) applicable law; and (iii) the
intellectual-property and usage terms of underlying AI vendors. You
acknowledge that AI-generated material may not qualify for copyright
or other intellectual-property protection in all jurisdictions and
that copyright eligibility, scope, ownership, registration, and term
may vary by jurisdiction, including the United States, and in
jurisdictions that require sufficient human authorship for some or
all protection or registration.
You further acknowledge
that additional human authorship, editing, or selection may be
required for certain protections or registrations. Bookcicle retains
ownership of all prompts, templates, workflows, and tools used to
operate the services.
No Copyright or Registration
Guarantee.
Bookcicle does not represent or warrant that any Deliverable, in
whole or in part, is copyrightable, registrable, enforceable,
exclusively owned by you, or eligible for any particular scope,
duration, presumption, or remedy under any jurisdiction’s laws. Any
decision to register, publish, license, enforce, disclaim, or
describe authorship in connection with a Deliverable is solely your
responsibility.
Human Contribution, Disclosure, and
Recordkeeping.
If you intend to claim authorship, ownership, or registration in a
Deliverable, you are solely responsible for determining what human
creative contribution, selection, coordination, arrangement, editing,
rewriting, curation, or other modification is required under
applicable law; for making any legally required or platform-required
disclosure regarding AI assistance, authorship, or unclaimable
AI-generated material; and for maintaining records sufficient to
substantiate your claimed human contribution, including drafts,
prompts, source materials, revisions, and editorial changes.
Bookcicle has no duty to advise you on those requirements or to
preserve records on your behalf for evidentiary or registration
purposes except as expressly required by law or stated in writing.
No Legal Authorship Advice.
Bookcicle does not determine the legal author, co-author, claimant,
or rights holder of any Deliverable for purposes of copyright,
moral rights, registration, publishing disclosures, chain of title,
or infringement claims, and nothing in the services should be
construed as legal advice on those issues.
Third-Party Vendors.
AI-generated material may originate, in whole or in part, from
third-party AI Systems. To the extent any liability arises from the
operation or output of such systems, such liability rests with those
vendors under their respective terms. Bookcicle’s liability for
third-party AI output is limited to the fullest extent permitted by
law.
Turnaround Estimates.
Any quoted completion window, turnaround time, service speed, or
processing estimate on the Site, in checkout, or in communications is
an estimate only and not a guaranteed delivery commitment, service
level, or time-is-of-the-essence obligation.
Advanced QA Add-On (Advisory Only).
If you purchase our Advanced QA add-on, Bookcicle may use AI to flag
passages that may raise originality concerns. This is a
heuristic advisory (not a definitive plagiarism determination) and may
include suggested edits or citations. You remain responsible for final
review and compliance decisions.
Indemnification & Limits.
Without limiting other provisions of these Terms (see
Indemnification, Disclaimer of Warranties, and
Limitation of Liability), you agree to defend, indemnify, and
hold harmless Bookcicle from claims arising out of your inputs or your
use, publication, or distribution of AI-generated content.
Refusal or Suspension.
Bookcicle may refuse, delay, suspend, or terminate processing of any
AI-service request if we reasonably believe the inputs, instructions,
requested outputs, or surrounding circumstances create legal, policy,
vendor-compliance, safety, abuse, operational, or reputational risk.
